Service Terms
Effective October 20, 2026
These Service Terms are an agreement between you and Evenvale Lighting (“Evenvale,” “we” or “us”). They apply when you use this website, including its estimates, Design Studio and chat, and when you request or receive our services. Each project is also governed by a written proposal or agreement you sign with us; if it conflicts with these terms, the signed agreement controls. By using this website, sending us a request or accepting our services, you agree to these terms. Please read the sections on warranty, liability and disputes carefully, because they limit our responsibility and explain how disagreements are resolved.
The short version
- Prices, estimates and AI concepts on this site are guides, not quotes or promises.
- Your project is set by the written agreement you sign, which controls over these terms.
- You handle HOA and other approvals, give us safe access and tell us about your property’s condition.
- Holiday lights we provide stay ours; permanent systems become yours once paid in full.
- Our liability is limited as far as California law allows.
- If something goes wrong, talk to us first, then mediation, then the courts of Riverside County.
This summary is for convenience only. The full text below is what applies.
01Estimates and pricing
Price ranges, package matches, budget comparisons, travel fees and minimums shown on this website, in our emails or by the chat are general estimates for typical homes, based on the information you give us. They are not offers, quotes, bids or contracts, and they may change at any time without notice.
Your final price depends on our review of your property, including rooflines, height, pitch, roof materials, access, power and existing conditions, and on the design you choose. Only a written proposal or agreement signed by both of us sets the scope and price of your project. A proposal is valid for the period stated on it, or 30 days if none is stated, and may be revised if the information it relies on proves inaccurate.
We work to keep this website accurate, but errors happen. We may correct any error, including a pricing error, at any time, and we aren’t bound by an obvious mistake. Unless your agreement says otherwise, prices don’t include taxes, permit or HOA fees, repairs to your home or work outside the agreed scope.
02Design Studio, chat and AI content
Design Studio concepts and briefs, and replies from the website chat, are generated by artificial intelligence for inspiration and general information only. They may be inaccurate or incomplete, may not reflect what can be installed on your home, and are not measurements or engineering, electrical, building code, HOA or legal advice. Website images labeled “Concept” are illustrations, not completed Evenvale projects.
The chat is an automated assistant. Nothing it says is an offer, a promise or a change to these terms, and it can’t make commitments for us; only a written proposal or agreement signed by Evenvale binds us. If anything the chat says conflicts with these terms or your agreement, these terms and your agreement control.
Lighting looks different in person. LED color, brightness and appearance vary with products, production batches, surfaces, distance, weather, cameras and screens, so your installed lighting may differ from any concept, photo or demonstration.
03Photos and content you send us
You must own the photos and content you send us or have permission to share them. They must not show other people without their consent or include anything unlawful or harmful, and you’re responsible for what you send.
You give us a non-exclusive, royalty-free permission to store, copy and process your photos and content, including with our AI and other service providers, to create your concept, respond to you, prepare your proposal and provide our services. We won’t publish photos or concepts you send us without your permission.
04Proposals and project agreements
We schedule work only after you sign a written proposal or agreement and pay any deposit it requires. It describes the scope, products, price, payment schedule and estimated timing, and includes the notices California law requires, including any right to cancel. Any change to the scope must be agreed in a written change order signed by both of us, and may change the price and schedule.
If we find a condition that couldn’t reasonably be seen during our review, such as damaged or rotted wood, loose gutters, unsafe wiring, bee or wasp nests, or roofing that can’t safely support the work, we may pause the work, adjust the design or propose a change order. Repairs and pest removal aren’t included unless agreed in writing.
We may decline any request, and may cancel a project before work begins for safety reasons, property conditions or other lawful reasons; if we do, we’ll refund any payment for work not performed. We may use our own team members or subcontractors to do the work.
Our proposals, layouts and designs remain our property. They’re provided so you can decide whether to work with us, and may not be shared with other installers or used to have our design installed by others without our written permission.
05Your property, access and approvals
You confirm that you own the property or have the owner’s permission for the work, and that the work is allowed under any homeowners’ association (HOA), landlord or community rules. Unless your agreement says otherwise, you’re responsible for getting HOA and other private approvals. If changes or removal are required later because an approval wasn’t obtained, that work is billable.
On scheduled days, please give us safe access to the work areas and the power source described in your proposal, secure pets, turn off sprinklers, move vehicles and belongings out of the way, and tell us about known hazards, fragile surfaces, solar panels, existing damage and prior repairs. We may pause or reschedule for unsafe conditions, weather or lack of access, and a trip that’s wasted because we can’t reach the work areas may be charged.
Installation involves ladders, clips and fasteners. We work with care, but small marks, fastener holes, minor disturbance to plants and turf near ladders, and normal wear around mounting points are an expected part of the work. Removing lighting later may leave visible holes or paint differences; patching and painting aren’t included unless agreed.
Clay and concrete roof tiles can crack under normal handling, especially when aged or brittle. We take reasonable precautions, but we aren’t responsible for damage to tiles, roofing, fascia, gutters, stucco or wiring that results from their existing condition. Attaching hardware may also affect a roof, gutter, paint or solar warranty, so please check those warranties before installation; we aren’t responsible for their terms.
06Power, electrical and smart controls
We connect to existing exterior outlets or the power source described in your agreement. New outlets, circuits or hardwired connections are included only if your agreement says so, and may require a permit and added cost.
We aren’t responsible for problems caused by your home’s wiring, outlets, breakers or GFCI devices, by power outages or surges, or by other devices on the same circuit, and service visits for them may be charged. You’re responsible for the electricity your lighting uses.
Smart apps, timers and controllers depend on your Wi-Fi, your devices and the manufacturer’s software and servers, which we don’t control. We aren’t responsible for changes to, outages of or discontinuation of third-party apps or services, or for problems caused by your network. We set up the schedules and scenes described in your agreement; later changes may be charged as a service visit.
07Holiday lighting
Unless your agreement says otherwise, holiday lighting service covers the lights we provide, installation, takedown and off-season storage of those lights. Service is booked one season at a time and doesn’t renew automatically.
Installation and takedown are scheduled in the order bookings are confirmed and may shift with weather and demand; we don’t guarantee a specific date unless your agreement does. Early takedown, extended display and extra visits can be arranged and may be charged.
If something stops working during the season, contact us and we’ll address it within a reasonable time as described in your agreement. Visits for problems caused by others, pets, tampering, landscaping or roof work, or your home’s power may be charged.
Lights and decor we provide remain our property unless your agreement says they’re sold to you. You’re responsible for their loss or damage beyond normal wear and weather, including from theft, vandalism, pets or tampering, which may be charged at replacement cost. If we can’t reach our lights at the scheduled takedown, a return trip fee may apply.
We may decline to install lights or decorations you supply. We aren’t responsible for their condition or performance, or for damage to them during normal handling, and we don’t store them unless agreed in writing. We also aren’t responsible for the natural condition of trees and plants we decorate, including branches that break because of it.
08Permanent lighting
Your permanent lighting system and its parts become yours when paid in full. Until then, we keep any rights the law allows, including lien rights.
We install the products named in your agreement. If one becomes unavailable, we may substitute a product of equal or better quality at no added cost after telling you.
Removing, relocating or reinstalling your system for roof, gutter, paint or stucco work isn’t included, and we can quote it separately. If anyone other than us removes, modifies or reinstalls the system, our warranty for the affected parts ends.
09Payment, travel and service area
Deposits, progress payments and due dates are set out in your agreement and follow the limits of California law. We serve homes within about two hours of Temecula and may decline requests farther away. Travel fees apply per trip to homes outside our local area, and minimum project sizes apply to homes more than about an hour away, as shown with your estimate and agreement.
Overdue amounts may accrue interest at 10% per year, or the highest rate the law allows if lower, from the due date. While a payment is overdue, we may pause work or service, decline new bookings and remove holiday lights we own. A returned or reversed payment may be charged the fee California law allows, and reversing a payment for work we performed doesn’t cancel what you owe. Please contact us before disputing a charge so we can resolve it.
Under California law, contractors, subcontractors and suppliers who aren’t paid for improving your property may have the right to record a mechanics lien against it. Your agreement includes the notice the law requires.
10Cancellation and rescheduling
Any right to cancel that California law gives you, for example for many contracts signed in your home, applies and is explained in your agreement.
If you cancel after that, you pay for work already performed, custom or special-order materials that can’t be returned, and other costs we reasonably incurred, as set out in your agreement. We refund any amount you paid beyond that.
Please give us as much notice as possible to reschedule. A missed appointment or late change that wastes a trip may be charged a trip fee as stated in your agreement.
11Portfolio photos
We may photograph or film the exterior of our completed work for our portfolio, website and social media. We avoid or remove house numbers, street signs, license plates, people and other details that identify you or your address, and we won’t publish your name or address without your permission.
You can opt out at any time by telling us in writing. We’ll stop using images of your home in new materials, but can’t recall materials already published or shared by others.
12Warranty
Any warranty for our workmanship or the products we install is stated in your agreement, along with any manufacturer warranties we pass on to you. Unless your agreement says otherwise, the remedy under our warranty is repair or replacement, at our choice, or a refund of the price of the affected part if repair isn’t practical.
To make a claim, contact us within the warranty period and give us reasonable access to inspect. Warranties don’t cover damage from misuse, accidents, alterations, removal or repairs by others, roof, gutter or paint work, power problems or lightning, animals and pests, severe weather, pressure washing, or normal fading and wear, or issues with apps, Wi-Fi or other third-party services.
To the fullest extent the law allows, we disclaim all other warranties, express or implied, including warranties of merchantability and fitness for a particular purpose. Any implied warranty that can’t be disclaimed is limited to the length of our written warranty, as the law allows. This website, its estimates and AI content are provided “as is” and “as available.” Nothing in these terms limits rights you have under California law that can’t be waived.
13Limitation of liability
To the fullest extent the law allows, Evenvale isn’t liable for indirect, incidental, special, consequential or punitive damages, lost profits or loss of use arising from this website, its estimates or AI content, or our services, even if we were told they were possible.
Our total liability for any claim relating to our services is limited to the amount you paid us for the service the claim relates to. Our total liability for any claim relating only to this website, its estimates or AI content is limited to $100.
These limits don’t apply where California law doesn’t allow them, including for fraud, willful injury, gross negligence, violations of law, or bodily injury caused by our negligence.
14Your responsibilities
To the extent the law allows, you agree to cover claims, losses and reasonable costs, including attorney’s fees, that we incur because of inaccurate information you gave us (including about ownership or approvals), your failure to get a required approval, items you supplied, changes or tampering by you or others after installation, or your breach of these terms or the law. This doesn’t apply to the extent a loss was caused by our own negligence or misconduct.
15Using this website
You must be at least 18 to use this website or request services, and you may use it only for genuine requests. Don’t submit false information or other people’s details without permission; upload harmful or unlawful content; try to disrupt, overload, scrape or gain unauthorized access to the site; use bots or automated tools; or try to manipulate the chat or AI features into producing harmful or misleading content or revealing how they work. We may block access or refuse requests we believe are abusive.
The website’s design, text, photography, illustrations and the Evenvale name and logo belong to Evenvale or its licensors and may not be copied or used without our permission.
The website and its features may change, be interrupted or be discontinued at any time. Links to third-party websites and apps are provided for convenience, and we aren’t responsible for them.
You agree that we may communicate with you electronically, that electronic records and signatures are binding, and that we may call, text or email you about your request or project using the details you provide. Message and data rates may apply.
16Resolving disputes
If you have a concern, please contact us first and describe it in writing so we can try to resolve it within 30 days. For concerns about our work, you agree to give us a reasonable opportunity to inspect it and make repairs before taking other action.
If we can’t resolve it, we each agree to try non-binding mediation in Riverside County, California, before filing a lawsuit, sharing the mediator’s fees equally. This doesn’t apply to small claims court or to requests for urgent court orders. A party who files a lawsuit without first offering to mediate may not recover attorney’s fees.
These terms are governed by California law. Any lawsuit will be brought in the state courts of Riverside County, California, and either of us may use small claims court for eligible claims. In any lawsuit to enforce these terms or a signed agreement, the prevailing party may recover reasonable attorney’s fees and costs, subject to the mediation requirement above. If your signed agreement provides a different dispute process, that process controls.
17General terms
We aren’t responsible for delays or failures caused by events beyond our reasonable control, such as weather, fire, utility or supply disruptions, illness, emergencies or government action.
If there’s a conflict, your signed agreement controls over these terms, and these terms control over other website content. If any part of these terms is unenforceable, the rest remains in effect and that part applies to the extent the law allows. Not enforcing a term isn’t a waiver of it. You may not transfer your rights under these terms or your agreement without our written consent; we may transfer ours to a successor business.
We may send notices to the email address you gave us, and you can send notices to us using the contact details below. We may update these terms from time to time; the effective date at the top shows the current version, which applies to later use of the website and new requests. A signed agreement keeps the terms in effect when it was signed.
